DMCA Policy
Ducks Player Performance respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, Ducks Player Performance will respond expeditiously to claims of copyright infringement committed using the Ducks Player Performance service and/or the Ducks Player Performance website (the "Site") if such claims are reported to Ducks Player Performance's Designated Copyright Agent identified below.
If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Ducks Player Performance's Designated Copyright Agent.
Filing a DMCA Notice of Alleged Infringement
Upon receipt of a valid DMCA Notice, Ducks Player Performance will remove or disable access to the allegedly infringing content. To be effective, a DMCA Notice of Alleged Infringement must be in writing and include substantially the following:
- Identify the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identify the material that you claim is infringing (or to be the subject of infringing activity) and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., URL(s) of the specific content).
- Provide information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address at which you may be contacted.
- Include the following statement: "I have a good faith belief that use of the copyrighted materials described above as allegedly infringing is not authorized by the copyright owner, its agent, or the law."
- Include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Deliver this Notice, with all items completed, to Ducks Player Performance's Designated Copyright Agent using the contact information provided on our contact page.
DMCA Counter-Notification
If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the content in your content, you may send a Counter-Notification to Ducks Player Performance's Designated Copyright Agent containing the following information:
- Your physical or electronic signature.
- Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of a mistake or a misidentification of the content.
- Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Ducks Player Performance may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
